1️⃣ The big picture: South Korea is pioneering an innovative approach to wildlife conservation by considering granting ‘legal personhood’ status to bottlenose dolphins living off Jeju Island. This groundbreaking initiative aims to protect these intelligent marine mammals from threats including boat strikes, fishing gear entanglement, construction noise, pollution, and fish farm runoff. The proposed amendment would recognize Indo-Pacific bottlenose dolphins as eco-legal entities with certain rights and legal protections. If approved, this would be the first time Korea has granted such status to an animal, joining a growing global movement that recognizes the legal rights of nonhuman species.
2️⃣ Why is this good news: The legal personhood initiative creates a framework allowing advocates to take action on behalf of dolphins when companies or individuals threaten their wellbeing. A committee will be established specifically to advocate for and protect dolphin rights, with dedicated funding mechanisms to support conservation efforts. In addition, a marine protected area was already designated on the west side of Jeju Island in April to safeguard these mammals. This approach to conservation recognizes the intrinsic value of these intelligent creatures beyond their utility to humans, potentially setting a precedent for how other species might be protected both in Korea and globally.
3️⃣ What’s next: The Jeju government will work toward passing a revision to the Special Act on the Establishment of Jeju Special Self-Governing Province to officially designate the dolphins as Korea’s first eco-legal persons. Conservation groups hope to expand protection measures beyond the current marine protected area to cover the entire western side of the island. Advocates will continue personalizing the dolphins through identification programs to help locals better relate to and support their protection.
